Nothing in these Terms obligates CreationUnited to provide, maintain, renew, restore, or continue any Account.

CreationUnited may perform maintenance or operational activities without prior notice where reasonably necessary.
7. Subscriptions, Memberships, and Paid Services

Where CreationUnited processes personal data on behalf of a customer in a controller-processor relationship, a Data Processing Agreement may be made available where required.

You retain ownership of User Content that you lawfully own.

CreationUnited does not guarantee permanent storage, preservation, recoverability, availability, retention, or restoration of User Content.

CreationUnited may retain applicant information for future opportunities, talent identification, workforce planning, recruitment activities, and legitimate business purposes unless prohibited by applicable law or otherwise requested by the applicant.
Nothing contained within the Services shall be interpreted as a promise, guarantee, commitment, or obligation to offer employment, engagement, compensation, sponsorship, funding, collaboration, or future opportunities.

Access to the Services does not grant ownership of any intellectual property rights.

References to open source, open-source contributions, community projects, or related initiatives do not imply sponsorship, endorsement, governance authority, ownership, or affiliation with any specific project, foundation, organization, or community unless expressly stated.
CreationUnited reserves all rights in proprietary materials that are not explicitly released under an open-source license.

Except where expressly authorized in writing, users may not:

- Build corpora

- Create vector databases

- Bots

- Third-party tools
Organizations seeking rights to use CreationUnited content, publications, archives, research materials, proprietary datasets, documentation, educational resources, or other materials for artificial intelligence, machine learning, model development, retrieval systems, knowledge systems, or related purposes must obtain prior written authorization.
Any such authorization may be subject to:

Unless expressly stated otherwise, such references shall not be interpreted as representations that CreationUnited possesses a specific certification, accreditation, registration, regulatory approval, audit opinion, compliance designation, or similar formal recognition.
ISO 27001 Alignment
CreationUnited follows and incorporates various security practices, controls, and processes that are generally aligned with principles commonly associated with ISO/IEC 27001 and related information security frameworks.
However, CreationUnited does not represent that it is currently certified, registered, audited, or formally accredited under ISO/IEC 27001 unless expressly stated and supported by official certification documentation.
Any reference to ISO 27001 reflects operational alignment with security best practices and shall not be interpreted as a claim of certification.
PCI DSS
CreationUnited does not independently operate payment card processing infrastructure and does not represent that it is itself PCI DSS certified.

- The Services will be uninterrupted.
- The Services will be free from errors.
- Defects will be corrected.

- Services will remain available indefinitely.

- User Content will be preserved.
- Systems will be immune from failures, outages, attacks, or disruptions.

regardless of the theory of liability and even if advised of the possibility of such damages.
To the fullest extent permitted by law, CreationUnited's aggregate liability for all claims arising out of or relating to the Services shall not exceed the greater of:
- One hundred United States Dollars (USD $100), or
- The amount actually paid by the user to CreationUnited during the twelve (12) months immediately preceding the event giving rise to the claim.
Certain jurisdictions do not permit limitation of certain liabilities. In such jurisdictions, liability shall be limited to the maximum extent permitted by law.
Nothing in these Terms excludes liability that cannot legally be excluded.
21. Indemnification
You agree to defend, indemnify, and hold harmless CreationUnited and its owners, partners, affiliates, directors, officers, employees, contractors, representatives, licensors, researchers, contributors, successors, assigns, and service providers from and against any claims, actions, proceedings, liabilities, damages, losses, costs, expenses, judgments, settlements, penalties, fines, and reasonable legal fees arising from or relating to:

- Your infringement of third-party rights
- Your misuse of intellectual property

CreationUnited reserves the right to assume exclusive control of any matter subject to indemnification at your expense.

23. Suspension and Termination
CreationUnited may suspend, restrict, disable, limit, remove, or terminate access to any Service, Account, Content, feature, product, platform, or resource at any time where reasonably necessary.
Reasons may include:

- Abuse prevention
- Operational requirements
- Legal obligations
- Regulatory requirements

- Service retirement
CreationUnited shall not be obligated to restore access following suspension or termination.

Certain obligations that by their nature should survive termination shall remain in effect, including but not limited to:

24. Export Controls and Sanctions
Users agree to comply with all applicable export control laws, trade restrictions, sanctions regulations, embargoes, and international trade requirements.
Users may not use the Services:
- In violation of applicable sanctions
- For prohibited end uses
- For prohibited end users
- For prohibited destinations
- For activities restricted by applicable law
CreationUnited reserves the right to restrict, suspend, deny, or terminate access where required by applicable legal, regulatory, or compliance obligations.
25. Governing Law and Dispute Resolution
CreationUnited operates internationally through various entities, affiliates, representatives, contractors, and future legal structures.
Accordingly, governing law, venue, and dispute resolution procedures may vary depending upon:
- The Service involved
- The applicable agreement
- The relevant legal entity
- The user's jurisdiction
- Applicable legal requirements
Where a separate agreement specifies governing law or dispute resolution procedures, that agreement shall control.
For Services not governed by a separate agreement, disputes shall be governed by the laws applicable to the CreationUnited entity providing the relevant Service, without regard to conflict-of-law principles.
The parties agree to attempt good-faith resolution of disputes before initiating formal proceedings.
Business-to-Business Disputes
Where permitted by applicable law and where the user is acting on behalf of a business, organization, or other non-consumer entity, disputes arising from or relating to the Services may first be submitted to confidential arbitration before a mutually agreed arbitrator or arbitration body.
Any such arbitration shall:
- Be conducted in English
- Be confidential
- Be conducted remotely where practical
- Follow commercially reasonable procedures
Consumer Rights
Nothing in these Terms requires a consumer to submit disputes to arbitration or waives any non-waivable rights, remedies, protections, or forums available under applicable law.
Where applicable law gives consumers the right to pursue claims before courts, tribunals, regulators, ombudsman bodies, or other competent authorities, those rights remain unaffected.
Nothing in this section prevents either party from seeking:
- Injunctive relief
- Equitable relief
- Intellectual property protection
- Emergency legal remedies
through a court of competent jurisdiction.
26. Changes to These Terms
CreationUnited may update, modify, revise, replace, supplement, or amend these Terms at any time.
Changes may occur due to:
- Legal developments
- Regulatory requirements
- Product changes
- Operational changes
- Security considerations
- Business developments
- Technological changes
Updated Terms become effective upon publication unless otherwise specified.
Continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
Users who do not agree to revised Terms must discontinue use of the affected Services.
27. Entire Agreement
These Terms, together with any incorporated policies, disclosures, notices, service-specific agreements, subscription agreements, licensing agreements, and related legal documents, constitute the entire agreement between the parties regarding the Services.
No waiver of any provision shall be deemed a continuing waiver.
If any provision is found unenforceable, invalid, or unlawful, the remaining provisions shall remain in full force and effect.
CreationUnited's failure to enforce any right or provision shall not constitute a waiver of that right or provision.
Users may not assign or transfer rights under these Terms without prior written consent.
CreationUnited may assign, transfer, delegate, or otherwise dispose of its rights and obligations under these Terms without restriction.

CreationUnited may require reasonable verification before responding to certain requests, exercising rights, processing account-related actions, or providing protected information.
By accessing, browsing, registering for, subscribing to, purchasing, submitting information to, participating in, or otherwise using any Service operated under the CreationUnited brand, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use and all policies incorporated by reference.
